Jointly Filed I-751 Petition Approved

When an individual receives a green card based upon a marriage that is less than 2 years old the green card they receive is only valid for 2 years.  Within the 90 day period prior to the expiration date of the green card the individual must file Form I-751 Petition to Remove Conditions on residence.  If the I-751 Petition is not timely filed the resident status will be terminated by operation of law and the individual could be placed in removal proceedings before the Immigration Judge.  The most common way to file Form I-751 is to file jointly with the spouse.  We recently received an approval of a jointly filed I-751 petition a few months after filing without an interview.  Our Philadelphia immigration attorneys submitted a substantial amount of evidence of the bona fide nature of the marital relationship since the date of issuance of the green card.  The evidence we submitted included bills in their names, mail that comes to the same address in either or both names, insurance (auto, health, life), joint tax returns, joint bank statements, e-mails sent to each other, facebook pages, lease/deed, automobile registrations, driver’s licenses at same address, credit cards that are the same, pictures, and cell phone records showing calls to each other.  It is important to cover as much of the time period as possible so, for example, we sent the bank statements for each month during the 2 year period.
