The U.S. Department of Labor Certified a PERM Application for Permanent Employment Certification based upon the initial electronic filing for the position of Traffic Engineer which is a Civil Engineering position involving the preparation of various types of traffic studies and traffic facilities and systems design.

Our law firm filed a PERM case for a Spa Manager working in California.  Prior to filing the PERM application we obtained the prevailing wage for the position, prepared the required notice of filing for the employer to post at the work location, and prepared the recruitment consisting of a 30 day state job order, 2 Sunday Newspaper ads, and advertisements on the employer web site, on a job search web site and on the web site of a professional organization.  The position required a Bachelor's Degree plus 2 years experience in the job offered.  The employer conducted recruitment for the position based upon the applications received and the recruitment failed to yield any ready, willing, qualified and available U.S. workers for the position.  As a result, the PERM case was certified by the U.S. Department of Labor.  We are now in the process of preparing a filing with U.S. CIS based upon the certified labor certification application.

A PERM Labor Certification Application filed for the position of Clinical Neurophysiologist by an employer in the Philadelphia Metropolitan Statistical Area was certified by the United States Department of Labor without an audit.  The Application was filed in March 2009 indicating a processing time of 10 months.  The pre-filing recruitment efforts consisted of 2 Sunday newspaper advertisements in the Philadelphia Inquirer, a 30 day job order with Pennsylvania Careerlink, and advertisements on Careerbuilder.com, with a professional journal, and on the career section of the employer's website.  The recruitment efforts did not yield any ready, willing, qualified and available U.S. workers for the position.  The employer may now file an I-140 Immigrant Petition for Alien Worker with United States Citizenship and Immigration Services on behalf of the foreign national employee.  The PERM Labor Certification Application was for an EB-2 position and the priority date is current meaning the foreign national is eligible to simultaneously file an I-485 Application for Adjustment of Status with the I-140 Petition.

PERM Labor Certification approved following audit for bridge designer position requiring Master's Degree in Civil Engineering plus 2 years bridge design experience.  In response to the audit it was demonstrated that the job requirements, which exceeded the Specific Vocational Preparation level assigned to the occupation as shown in the O*Net Job Zone, arose from business necessity.  In order to establish business necessity evidence was provided that the job duties and requirements bore a reasonable relationship to the occupation in the context of the employer's business and were essential to perform the job in a reasonable manner.

PERM Case approved for Operations Research Analyst at University whose job involves designing, implementing, documenting and maintaining systems that retrieve university data electronically for official reporting purposes and ensuring accuracy and consistency of data.  Position requirements were Master's Degree in Statistics, Public Administration, Social Science or related field plus 2 years experience working with higher education data.
