Our Philadelphia immigration law firm received an approval of a I-140 National Interest Waiver Petition filed with the USCIS Texas Service Center in 2 1/2 months. The Petition was filed on behalf of a researcher at a prestigious University in Philadelphia whose research findings have had a degree of influence of the field of embryology (the study of the development of an embryo from the fertilization of the ovum to the fetus stage) as a whole and whose work was above and beyond the substantial majority of others in the field. Our client is a citizen of Tanzania. In that the EB-2 priority date is current we are preparing to file an adjustment of status application on behalf of our client.

Our firm successfully processed a National Interest Waiver Petition for a researcher from China working at a prestigious University in Philadelphia conducting research in the field of understanding the molecular mechanisms of disease. The Chinese National had used the approved NIW I-140 Petition to extend H-1B status for an additional 3 year period beyond the 6 year maximum. The priority date of the I-140 Petition became current in May 2010 according to the Visa Bulletin and our Philadelphia immigration law firm, which continuously monitors the priority dates of our clients. contacted the Immigration Service to advise that the priority date was current. The adjustment of status applications, that had been filed years ago when the priority date had been current, were approved for the researcher and the derivative family members. If a Chinese or Indian national wishes to self-petition and potentially qualifies as an EB-1 Alien of Extraordinary Ability that is always the best way to proceed in light of the substantial EB-2 and EB-3 backlogs for Chinese and Indian Nationals. However, a successful EB-2 National Interest Waiver Petition is a viable strategy as the priority date is eventually reached and the NIW Petition allows the individual to remain in the United States in H-1B status until the green card is issued.

National Interest Waiver Petition approved for scientist conducting biochemistry/molecular biology research to understand the mechanisms of genetic information transfer from genes to proteins in order to develop therapeutic treatements to fix malfunctions in the transfer process. Documentation submitted in support of the Petition included reference letters from unbiased, independent experts in the field, journal publications, discussion of work by others worldwide, and receipt of an international award for outstanding achievement.

NIW Petition approved for researcher whose findings in the field of molecular neuroscience and embryology were considered to have been of widespread impact and importance to the field as a whole and substantially above and beyond the work of others in the field. Documentary evidence submitted in support of the I-140 NIW Petition included reference letters, publications, presentations at international conferences, a national award for outstanding achievement, a citation list, copies of articles discussing alien's research findings, letters from individuals who discussed the alien's research in their own publications discussing the impact and importance of the research on the field and letters from journal editors discusing the alien's review activity judging the work of others.
